A puppy contract template is a binding agreement between a breed and a puppy buyer. Usually, this type of agreement covers pricing, deposits, vaccine records, health guarantees, and other aspects. Additionally, it protects both parties by managing expectations and giving options if there are problems later.
This Puppy Sale Agreement (the "Agreement") is entered into as of (Date) (the "Effective Date"), by and between:
[Breeder.StreetAddress] [Breeder.City] [Breeder.State] [Breeder.PostalCode]
[Buyer.StreetAddress] [Buyer.City] [Buyer.State] [Buyer.PostalCode]
Collectively referred to as the "Parties."
WHEREAS, Breeder is the lawful owner of the following described puppy:
NOW, THEREFORE, in consideration of the mutual covenants contained herein and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties agree as follows:
This puppy contract template section covers costs such as vaccination, microchipping, grooming, and more. Outlining a payment plan, if you offer one, is important, too, so both sides understand the schedule.
The Buyer shall pay the Breeder a non-refundable deposit of $(Deposit Amount) to secure the puppy. This deposit shall be applied toward the total Purchase Price.
The Buyer shall pay the remaining balance of $(Remaining Balance) to the Breeder on or before the date of delivery or pickup of the puppy.
All payments shall be made in (Accepted Payment Method) to the following account:
(Breeder's Bank Account Information)
The puppy shall be (Delivered/Picked Up) by the Buyer on or before (Delivery/Pick Up Date). Any additional expenses related to the delivery of the puppy, including but not limited to transportation costs, health certificates, and crate fees, shall be the Buyer's responsibility.
To their knowledge, the Breeder represents that the puppy being sold under this contract (the "puppy") is in good health at the time of transfer. The Breeder further represents that the puppy has received appropriate vaccinations, is free from known contagious diseases, and has been examined by a licensed veterinarian.
The Buyer agrees to have the puppy examined by a licensed veterinarian within (Number) days of the Effective Date. Suppose the veterinarian determines the puppy to be unfit for purchase due to a pre-existing health condition. In that case, the Buyer must provide written notice to the Breeder within (Number) days of the examination date.
If, within (Number) days from the date of transfer, a licensed veterinarian certifies that the puppy is unfit for purchase due to a congenital or hereditary health issue, the Breeder agrees to replace the puppy with one of equal value, subject to the availability of such a replacement. The Buyer may choose to retain the puppy, in which case the Breeder will reimburse the Buyer for reasonable veterinary expenses, up to the puppy's purchase price, upon presentation of itemized veterinary bills.
This warranty does not cover conditions resulting from neglect, accidents, injury, or any other circumstances beyond the control of the Breeder. This warranty does not cover common and non-serious conditions such as parasites, external parasites, and other minor ailments.
The Breeder's liability under this warranty is limited to the puppy's purchase price. The Breeder is not responsible for any consequential damages, including but not limited to veterinary expenses, emotional distress, or loss of income.
Any claims under this warranty must be submitted in writing to the Breeder within (Number) days of the Buyer's discovery of the health issue. Failure to provide timely notice shall void this warranty.
This warranty constitutes the entire agreement between the Parties and supersedes all prior negotiations, understandings, or agreements, whether written or oral. Any modifications to this warranty must be in writing and signed by both Parties.
This section of a puppy contract template allows you to specify if the pup’s being sold with registration documents or if you offer that optionally for an added fee. If providing registration documents, spell out which registry they’ll be registered with – AKC (American Kennel Club), for example. In addition, outline the timeline for when a buyer can expect their paperwork after final payment.
The Breeder agrees to provide the Buyer with the necessary documentation to register the above-described puppy with the appropriate canine registration authority, such as the American Kennel Club (AKC) or other recognized breed registry.
The Breeder agrees to promptly transfer ownership of the puppy to the Buyer upon receipt of all necessary information and fees required by the registration authority. The Buyer agrees to provide the Breeder with accurate information for the registration, including the desired registered name and any other required details.
The Buyer shall be responsible for all costs associated with the registration process, including but not limited to registration fees and any additional expenses required by the registration authority. The Breeder shall not be held liable for any delays or issues arising from the registration process.
The Breeder warrants that, at the time of transfer of ownership, the puppy's registration papers shall be free from any restrictions except as otherwise specified in this Agreement.
The Buyer agrees not to transfer or attempt to transfer the registration of the puppy to any third party without the express written consent of the Breeder. Any unauthorized transfer of registration shall be considered a breach of this Agreement.
